What the Data Security Law Actually Means for SME IT Procurement

The Data Security Law took effect in September 2021. Three years on, many SME owners in Beijing have run into an awkward reality: compliance checklists keep getting longer, yet purchasing decisions have only become harder. Choosing an IT vendor used to come down to price and after-sales support. Now you also have to weigh whether their data security capabilities are up to standard. This is not manufactured anxiety — it is real regulatory pressure working its way downstream. Over the years I have done IT planning for manufacturing and trading companies, and nearly every client asks the same question: what data security credentials should we be looking at when we buy? Drawing on hands-on experience, this article unpacks how the Data Security Law affects IT procurement, focusing on classification and grading, cross-border transfer audits, localized storage, vendor assessment, and ISO 27001 alignment, and closes with a compliance checklist you can put to use right away.

Classification and Grading: The First Gate in Procurement Decisions

The core logic of the Data Security Law is “classified and graded data protection.” Article 3 states that data bearing on national security, the lifeblood of the national economy, important public livelihoods, or major public interest constitutes national core data and is subject to strict management; all other data is protected at graded levels according to its importance. This framework directly shapes how IT procurement is evaluated.

For SMEs, the first task is to get a clear picture of their own data before planning any purchase. Take an exporter of medical device components: customer order data, production process parameters, supplier quotes. These look unremarkable, but if medical device registration information or the regulatory requirements of export markets come into play, they may rise to the level of important data. Once data is designated important, the choice of storage media, network equipment, and even office software becomes constrained.

One of our clients, a food processing company in Shunyi, bought a used file server to build its own archive system. During a routine inspection, the district market regulator found that the server was hosted in a small data center with neither MLPS filing nor a data security management system. No penalty was imposed in the end, but the company was ordered to rectify the issue and had to purchase a compliant cloud storage service instead. The lesson: classification and grading is not a formality to tick off — it sets the security baseline for your entire procurement plan.

Cross-Border Transfer Audits and Localized Storage: Two Parallel Compliance Red Lines

Cross-border data transfer is where SME IT procurement most often trips up. Article 31 of the Data Security Law sets out the requirement for a security assessment before important data leaves the country, and the accompanying Measures for the Security Assessment of Data Export further detail the filing conditions and procedures. In practice, companies with annual revenue above RMB 10 million that transfer important data abroad must proactively file for a security assessment with the provincial-level cyberspace administration.

One practical detail deserves special attention: many companies assume data only “leaves the country” if the servers themselves are moved overseas. In fact, cross-border calls to SaaS services, overseas subsidiaries accessing domestic data, and even employees sending business files through foreign email providers can all be deemed outbound data transfers. I have seen a cross-border e-commerce company in Chaoyang buy a US CRM system that stored customer contacts and order data. Because it had never undergone an export assessment, the company was summoned by the regulator. The fix cost more than RMB 200,000 to buy a domestic CRM system and migrate all data back to servers inside China.

For IT Operations Outsourcing, choosing a local provider is far safer from a compliance standpoint than choosing an overseas supplier. Siwenlide has long-standing clients in Shunyi, Chaoyang, and Haidian, and our service team is entirely based in China — data never leaves the country. That is the most basic compliance commitment we make.

Vendor Assessment and ISO 27001 Alignment: Hard Currency in Procurement

Article 3 of the Data Security Law requires data processors to establish and improve a full-process data security management system, which means companies purchasing IT products and services are obliged to assess their vendors’ security capabilities. Whether a vendor can provide data security management documentation, whether it has a dedicated security officer, and whether it can cooperate with security audits have all become essential clauses in procurement negotiations.

ISO 27001 information security management system certification is currently the most widely recognized endorsement of data security capability on the market. Holding this certification means the vendor has established a complete information security management framework covering risk assessment, asset identification, security policy, internal audit, and management review. For SMEs, prioritizing IT vendors with ISO 27001 certification substantially lowers the risk of being challenged during a compliance review.

1. Ask the vendor to present the original ISO 27001 certificate, and check the validity period and certification scope to make sure the IT services you are buying are covered
2. Verify whether the vendor holds MLPS Level 2 or Level 3 filing, and confirm that the filing level matches the sensitivity of the data being processed
3. Confirm whether the vendor’s data security management system covers the key areas: data classification and grading, access control, encryption requirements, and incident response
4. Assess the vendor’s physical and environmental security — whether the hosting data center has basic safeguards such as fire protection, temperature control, and intrusion alarms
5. Review the vendor’s record of past security incidents and how they were remediated, to gauge its security operations capability

It is worth noting that the Data Security Law and ISO 27001 align quite closely in their underlying logic. ISO 27001 emphasizes the risk management process, while the Data Security Law requires companies to establish a data security management system and carry out risk assessments. The point where the two meet is risk assessment methodology — when mapping data assets and assigning classification and grading, companies can reuse ISO 27001 risk assessment tools and templates directly, saving duplicated effort.

If a company runs into a vendor that cannot provide the relevant credentials during IT procurement, it can consider a product bundle with enhanced security features. The Network Equipment Package from Siwenlide covers not only equipment supply and deployment during the contract term, but also security configuration and operations guidance, helping clients translate compliance requirements into technical practice.

A Data Security Compliance Checklist for SME IT Procurement

Based on the analysis above, I have organized the practical requirements the Data Security Law places on IT procurement into an action checklist for IT managers and business owners. This is not legal advice, but it broadly covers the points regulators commonly examine.

Step one: map and classify your data assets. This is the starting point for all compliance work, and the step most easily skipped. Set aside a week to chart the data types, storage locations, access personnel, and flow paths associated with your core business systems, and turn them into a data asset inventory. Follow the Guidelines for Data Classification and Grading to sort data into three levels: core data, important data, and general data. Get this right and later procurement decisions will have a foundation.

Step two: assess the compliance gap in your existing IT architecture. Against the classification and grading results, check whether your current servers, storage devices, network equipment, and cloud services meet the corresponding security requirements. Pay particular attention to whether data is mistakenly stored on overseas servers or in uncertified data centers, whether access rights follow the principle of least privilege, and whether sensitive data is encrypted at rest and in transit.

Step three: define the security specifications for new purchases. Based on the gap analysis, set out clear data security clauses in your procurement requirements. Key elements include: vendor credential requirements (ISO 27001, MLPS certification), data storage location requirements (must be in China), data export restriction clauses, security incident response timeframes, service continuity guarantees, confidentiality obligations, and liability for breach.

Step four: security due diligence before signing. Do not skip this — doing it thoroughly saves a great deal of trouble later. Ask the vendor for its certificates, security policy documentation, and incident response plans, and where necessary arrange an on-site visit to see the data center environment and the operations team first-hand.

Step five: ongoing oversight during contract performance. Data security compliance is not a one-off project. Companies should review the validity of vendor credentials at least once a year, keep up with vendor security bulletins and incident notifications, and update their internal data security management system in good time.

For micro and small businesses without dedicated IT staff, we recommend choosing an IT Operations Outsourcing service with complete security credentials and handing the compliance burden as a whole to a professional provider. Of the more than 300 clients Siwenlide serves, many have resolved their data security compliance worries this way.

The Data Security Law has genuinely added complexity to SME IT procurement, but it also pushes companies to re-examine how well they manage their data assets. Turning compliance requirements into procurement standards not only gets you through regulatory inspections, it also measurably strengthens your own network security defenses. A rigorous procurement requirements document and a complete vendor assessment process are, in effect, laying the foundation for your company’s data security.
